Terms of Service
1. Agreement
These Terms of Service (“Terms”) govern your use of Mindling’s mobile applications, websites, and related services (collectively, the “Service”). By downloading, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be old enough to enter a binding contract where you live (and at least 13, or the digital‑consent age in your region). If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
3. License
Subject to these Terms, we grant you a personal, non‑exclusive, non‑transferable, revocable license to use the Service for your own non‑commercial entertainment and wellbeing motivation. You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract source code from the Service except where law forbids those restrictions.
4. Accounts
You may need an account. You are responsible for your credentials and for all activity under your account. Notify us promptly at support@mindling.pet if you suspect unauthorized access.
5. Virtual items and payments
The Service may include virtual currency, items, or other digital content (“Virtual Items”). Virtual Items have no real‑world monetary value, are non‑redeemable for cash, and are licensed—not sold—to you. Purchases are processed by app stores or other payment providers; their terms also apply. Prices and availability may change. Except where required by law or store policy, all purchases are final.
6. Screen time and permissions
Some features rely on operating‑system permissions (for example Screen Time or Digital Wellbeing). The Service only accesses data you authorize. If you deny permissions, parts of the experience may be limited or unavailable.
7. Acceptable use
You agree not to:
- Violate law or others’ rights;
- Interfere with or overload the Service;
- Circumvent security, quotas, or payment;
- Use the Service to harass, exploit, or endanger anyone;
- Upload malware or attempt unauthorized access to our systems or users’ data.
8. Not medical advice
Mindling is a wellbeing companion for motivation and self‑awareness. It is not a medical device and does not provide medical, therapeutic, or crisis services. For health concerns, consult a qualified professional. If you are in crisis, contact local emergency services or a crisis hotline.
9. Intellectual property
The Service, including branding, art, text, and software, is owned by Mindling or its licensors and protected by intellectual property laws. Feedback you give us may be used without obligation to you.
10. Third‑party services
The Service may link to or rely on third parties (stores, analytics, hosting). Their terms and privacy policies govern those services.
11. Disclaimer
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non‑infringement. We do not guarantee uninterrupted or error‑free operation.
12. Limitation of liability
To the fullest extent permitted by law, Mindling and its affiliates, directors, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of the Service. Our aggregate liability for claims relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the claim or (b) fifty US dollars, except where liability cannot be limited under applicable law.
13. Indemnity
You will defend and indemnify Mindling against claims arising from your use of the Service, your content, or your violation of these Terms, to the extent permitted by law.
14. Termination
You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe you violated these Terms or pose a risk to the Service or others. Provisions that by their nature should survive will survive termination.
15. Changes
We may modify the Service or these Terms. We will post updates here and, where material, provide reasonable notice in the app or by email. Continued use after the effective date constitutes acceptance unless the law requires otherwise.
16. Governing law
These Terms are governed by the laws applicable in the jurisdiction we designate for Mindling’s operating entity, without regard to conflict of law rules, except where consumer protections in your country require otherwise.
